1. Acceptance

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "User") and Ishan Sharma, operating as Mirelle (d/b/a flek.ai) ("Mirelle," "we," "us," or "our"). By downloading, installing, or using the Mac Storage Clear application ("the App"), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the App.

You must be at least 18 years old, or the age of majority in your jurisdiction, to enter into these Terms.

2. License

The App is open source and is licensed under the MIT License. The MIT License governs the source code and binaries that you build from source.

The version of the App distributed via the Mac App Store is licensed to you on the terms of Apple's standard End User License Agreement, as supplemented by these Terms. Where those terms conflict on a particular issue, the App Store EULA governs your distribution-channel rights and these Terms govern everything else, including warranty, liability, and disputes.

3. Apple-Specific Terms (App Store distribution)

The following provisions apply only when you obtain the App from the Mac App Store:

• These Terms are concluded between you and Mirelle, not Apple. Mirelle, not Apple, is solely responsible for the App and its content.
• Apple has no obligation to provide any maintenance and support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App to you. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.
• Mirelle, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection or similar legislation.
• In the event of any third-party claim that the App or your use of it infringes that party's intellectual property rights, Mirelle, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You represent that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

4. Refunds and Cancellations

The App Store version is a one-time purchase. Refunds for App Store purchases are handled exclusively by Apple under their refund policies. To request a refund, contact Apple Support via reportaproblem.apple.com. Mirelle cannot process refunds for App Store purchases.

5. Disclaimers

The App is provided "as is" and "as available," without warranty of any kind, express or implied.

To the maximum extent permitted by applicable law, Mirelle disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy, security, and the safe and complete preservation of your data.

The App performs destructive operations (deleting files). You are solely responsible for reviewing what you delete, maintaining backups, and verifying that any operation matches your intent. We strongly recommend keeping a recent Time Machine backup before using the App.

6. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Mirelle be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of data, loss of profits, loss of business, or damage to hardware, arising out of or in connection with your use of or inability to use the App, even if Mirelle has been advised of the possibility of such damages.

Mirelle's total cumulative liability for any claim arising out of or in connection with these Terms or the App shall not exceed the amount you paid for the App in the twelve (12) months preceding the event giving rise to the claim, or USD 9.99, whichever is greater.

7. Intellectual Property

The App's source code is MIT licensed. The "Mac Storage Clear" name, logo, and visual identity are trademarks of Mirelle and may not be used to imply endorsement of or affiliation with derivative works without written permission.

8. Governing Law and Disputes

These Terms are governed by the laws of India, including the Indian Contract Act, 1872 and the Information Technology Act, 2000, without regard to conflict of law principles.

Before initiating any formal dispute resolution, you agree to try to resolve the dispute informally by contacting support@flek.ai. If informal resolution fails, any dispute shall be settled by binding arbitration under the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Bengaluru, Karnataka, India, conducted in English by a single arbitrator.

For matters not subject to arbitration, the courts of Bengaluru, Karnataka, India have exclusive jurisdiction.

Class Action Waiver. You agree that any claim against Mirelle will be brought in your individual capacity only, not as a plaintiff or class member in any class or representative action.

EU Consumer Rights. If you are a consumer in the European Union, nothing in this section limits your right to bring proceedings in the courts of your country of residence or your rights under mandatory EU consumer protection laws, which take precedence over conflicting provisions.

9. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via the project GitHub repository and the App Store release notes. Your continued use of the App after changes take effect constitutes acceptance.
